TERMS AND CONDITIONS FOR RESIDENTS ENROLLED IN REZICLASS PROGRAM

1. Introduction

ReziClass is a service provider dedicated to establishing classes in Residential buildings throughout Manhattan. Classes can be held in building common spaces such as playrooms, as well as in private homes. The classes can be initiated by Residents, or by buildings that want to offer the service as an additional amenity to Residents.

ReziClass works with a variety of Class Providers who offer a wide range of educational and entertaining classes for all ages from birth and up at competitive pricing. Assisting throughout the entire process, ReziClass manages scheduling, collection of payment from participants, and payment to Class Providers.

ReziClass also offers free assistance with event planning, along with special discounts for ReziClass members.

2. Services

(a) Services Provided by ReziClass

To subscribe to the ReziClass services, Residents register basic information about themselves and other family members who may also participate in classes in the online Resident registration form.

ReziClass service to Residents includes:
- Wide range of classes and Class Providers for all ages (birth and up).
- Coordinating and scheduling with Class Providers.
- Collecting fees from multiple participants online.
- Facilitating communications between all class participants
- Free advice for event planning, and special discounts

ReziClass online system also allows Residents to:
- Receive email notifications about new Class Providers; new classes offered; new additional services; promotions and discounts; and other special events and offerings.
- View catalogue of classes offered through the ReziClass service, including Class Providers, descriptions, rates, and more.
- Request new classes; send online requests to neighbors to sign up for classes of common interest; and sign up for waitlists on classes in the building which are already full.
- Update personal and payment information and view personal history, including classes for which the family is registered (past, present and future);

Residents in buildings that offer ReziClass
How it works: Once Residents register with ReziClass, they can:
- View classes currently offered in the Resident’s building
- Register for a class
- Launch a New Class Request, which can easily be forwarded to neighbors, in case they want to sign up.
- Request new Class Providers

Residents in buildings that do not yet offer ReziClass:
If ReziClass is not yet offered in a building, a Resident may send the building information, and ReziClass will approach the building management. If the Resident knows the building management and would like to communicate with them directly, the Resident can enjoy a 50% discount on the first class for which the Resident registers.

Setting up classes in private homes:
Whether in a large building or a brownstone, ReziClass will facilitate collection of payment from the participants and pay the Class Provider.

Assistance with event planning and special discounts:
ReziClass offers an event planning service, which includes -
- Advice on entertainment options customized for the Resident’s event
- Referral to a wide range of entertainers and service providers
- Special discount reserved for ReziClass Event members
- Option to have ReziClass facilitate payment to service provider

Inactive accounts, i.e., Residents who do not renew their subscriptions, and who have not registered for classes via ReziClass in a year, will be de-activated. ReziClass also reserves the right to de-activate an account at its discretion. If a Resident is still enrolled in classes, the Resident may complete the class, but may be prevented from enrolling in future classes (this is in case someone is very difficult and does and often disrupts classes, etc.) ReziClass may also offer the Resident to have money reimbursed for the class in progress.

(b) Services Provided by Class Providers

ReziClass is dedicated to bringing quality classes to Residents’ building, based on their interest. However:

ReziClass is not responsible for the Resident’s satisfaction with the class or instructor, though ReziClass strives to ensure the quality of the services offered by encouraging Resident feedback through the ReziClass website, which is made available to Residents prior to registration.

ReziClass reserves the right to discontinue service with a Class Provider due to complaints and negative feedback about a class, instructor or class-provider, or otherwise. If the Class Provider has classes in progress for a semester, ReziClass will determine whether the provider should complete the semester or reimburse the students for the classes. ReziClass may prevent the Class Provider from starting any new class semesters.

Class Requests: ReziClass welcomes requests for new classes by Residents, but cannot be held responsible for supplying any/all classes requested. The class provided shall be based on the demand for a given class, and on the availability and willingness of Class Providers.

ReziClass shall not be responsible to changes made by Class Providers to class curriculum or class instructors.

Individual Class Provider policies: Class Providers may have additional policy requirements specific to their classes. These requirements shall be posted as part of the class registration page. All Residents enrolled and participating in classes where additional Class Provider policies are required are held accountable for adhering to those policies. If the policies are not adhered to, the Class Provider reserves the right to cancel that Resident’s participation in the class, and may choose to refund or not refund the Resident. ReziClass is not responsible to ensure the adherence to policies by the Residents, nor for providing a refund to the Resident whose enrollment has been cancelled under the terms mentioned above.

Guest Passes: Class Providers determine whether or not guests are allowed, and how many guest passes are permitted. Residents are held responsible to abide by the class policies, out of respect for fellow Residents who have paid for the classes where space is limited. Building management companies reserve the right to not allow guest passes, regardless of the Class Provider policy.

Class Providers in Private Homes: The Class Provider shall determine whether or not their classes are offered in private homes. If a Class Provider agrees to provide classes in private homes, the Resident who has agreed to hold classes in her/his must allow access to the Class Provider and to the class participants registered in the class for the duration of the class semester. Otherwise, the Resident will be held responsible to reimburse all parties, including the Class Provider, the class participants and ReziClass.

Class Providers are responsible for their own conduct. The Class Providers work independently of ReziClass, and do not represent ReziClass.

 

3. Fees

(a) Class Fees

The fee for each class will be posted on the ReziClass catalogue of classes. Amount for classes must be paid in full upon registration, to ensure a space in the class. A confirmation email for the class registration will be emailed to the Resident.

Payment may only be made online, using any major credit cards or debit cards. No other forms of payment are accepted.

Sibling/partner discounts are determined by each Class Provider, and shall be applied as such upon registration.

 

(b) Refunds

No cancellations or refunds of class fees shall be accepted, unless a Resident on waitlist fills the space in the class. Please see Section 3b below for further details.

 

4. Class Registration

Class registration is handled on a first-come, first-serve basis. No application/admission process is required.  All attendees must be registered, even if they are registered for free (e.g., infants, etc.) to avoid over-crowding.

 

(a) Waitlist

If a Resident would like to attend a class for which registration is already full and no space is available, ReziClass offers the option to put the Resident on waitlist.

Waitlist is handled on a first-come, first-served basis. If a space in a class is made available, ReziClass will contact the first person registered on the waitlist. If that Resident is no longer interested in registering for the class, ReziClass will contact the following person registered on the waitlist, and so on and so forth.

ReziClass cannot guarantee that the Resident will get a place in the class when the Resident is on waitlist. If a space is made available prior to the semester start, the waitlisted Resident who chooses to register for the class must pay the amount in full for the class. If the space is made available after the semester start, the waitlisted Resident who chooses to register for the class must pay only the pro-rated amount based on the number of classes remaining for the semester.

 

(b) Cancellations

No cancellations or refunds of class fees shall be accepted, unless a Resident on waitlist fills the space in the class.

If the cancellation occurs prior to the class semester start, the amount shall be reimbursed in full, once the waitlisted Resident has paid in full.

If the cancellation occurs after the class semester start, the amount shall be reimbursed on a pro-rated basis, based on the number of classes remaining, once the waitlisted Resident has paid. The waitlisted Resident shall be charged on a pro-rated basis based on the number of classes remaining.

Additionally, any cancellation that is reimbursed based on the conditions above shall also require a cancellation fee of $50.

 

(c) Make Up Classes

The option to provide make-up classes, and how many make-up classes are permitted per semester, depend on each Class Provider’s policy. If a Class Provider provides the option for make-up classes, ReziClass shall provide make-up vouchers, which can only be used at the Class Provider facilities.

If the Class Provider has multiple locations, the Class Provider determines, at its sole discretion, at which locations make-up classes can be made. These locations shall be specified on the voucher supplied by ReziClass. ReziClass shall not be responsible for determining the location(s) where make-up classes can be taken, or whether makeup classes are available.

 

(d) Scheduling

For every class, the Class Provider determines the number of sessions per semester, duration of the sessions, and the maximum number of people allowed per class. Class semesters are purchased as a package, and classes are not pro-rated, except for certain exceptions or special offerings by ReziClass and/or the Class Provider.

The Class Provider determines the calendar for the class, which will take into account major holidays, and other considerations. The calendar will be advertised prior to registration. The Class Provider will be held accountable to ensure classes are held according to the calendar.

In the event of a class session cancellation by the Class Provider, ReziClass will do its best to notify all class participants via email in a timely manner. The class-provider will also be held responsible for scheduling a make-up class session at the Residential building at the end of the semester. In case a class participant is unable to attend the rescheduled class, and according to the policy of the Class Provider, a make-up voucher will be issued whereby the student may attend a make-up class at the class-provider facilities. If the Class Provider is not able to provide a rescheduled make-up class session, the Class Provider will be held responsible to reimburse the students for that one class session in full, handled through the ReziClass payment system.

ReziClass reserves the right to cancel a class offering due to insufficient enrollment, prior to the semester start. Class times and locations may also be adjusted as necessary, prior to the semester start. In the event that Residents already enrolled in the class and cannot attend at the revised hour, a full refund shall be provided with no cancellation fees.

 

(e) Take Home Materials

In the event a Class Provider includes take-home materials as part of the class package and cost, the Class Provider is responsible for the content and distribution of the take-home materials.

 

5. Liability:

ReziClass shall not be responsible for any injuries incurred or accidents in any of the buildings, private homes, or class-provider facilities in which classes are held.

ReziClass shall not be responsible for any damage to property or to stolen or damaged items of any kind in any of the buildings, private homes, or class-provider facilities in which classes are held. Class participants shall be responsible for any and all items brought with them to class.

ReziClass is not and shall not be responsible for the conduct of any Class Provider or Class Provider instructors.

For reasons of safety and hygiene, ReziClass requests that no food or drinks be brought into the class at any time, with the exception or water, or medically required food (e.g., in the case of diabetes). Another exception is when the class is specifically focused on food. In any of these cases, ReziClass shall not be held responsible for any food-related hazards, such as allergic reactions, choking, or other incidents which may occur.

 

6. Conduct

Class participants are responsible for arriving to class on time. If the class participant arrives late, additional class time will not be made up for the Residents who come late.

All strollers shall be strictly prohibited from class rooms in buildings, as well as bicycles, tricycles, and other vehicles. Residents with infants may bring a car-seat or other small bassinet-like items in which to keep their infants throughout the class.

Parents or caregivers bringing infants to classes shall be required to take the baby out in case the baby cries and disturbs the class.

Parents or caregivers bringing infants shall be responsible for the behavior of the child(ren) they bring to the class. If the child misbehaves in a way that disrupts the class, (such as hitting, biting, or not listening to instruction) the class instructor has the right to request that the child be taken outside the class until the child can behave appropriately.
